Circuit Clerk Office Details

The Faulkner County Circuit Clerk is Nancy Eastham. The office is located at 724 Locust Ave., Conway, AR 72034. Phone: 501-450-4911. Office hours are 8:00 AM to 4:30 PM, Monday through Friday, except holidays.

The office mission statement describes the goal clearly: "To provide the judicial system and the public with efficient, equal, transparent, and accountable services while preserving the integrity of all records filed within the office." That commitment shows in the real estate division's approach. Staff are assigned specifically to recording and real estate inquiries, which keeps wait times down for deed searches and filings. Court cases have been scanned back to 2000, and court orders are available from 1997.

One policy worth noting: Faulkner County no longer accepts re-recordings of documents. If a deed has a minor clerical error, a scrivener's affidavit is the accepted fix. Major errors in a recorded deed require a corrective instrument rather than a re-recording. Make sure any deed submitted to this office is accurate before filing, because getting errors fixed after the fact takes extra steps here.

E-Recording and Electronic Filing

Faulkner County has been e-recording enabled since June 1, 2016. This means title companies, attorneys, and lenders can submit deed instruments electronically through approved vendors and receive same-day recording without traveling to the Conway courthouse. Four vendors are approved for e-recording in Faulkner County: CSC eRecording Solutions (1-855-200-1150), Simplifile (1-800-460-5657), eRecording Partners Network (ePN) at 1-888-325-3365, and Indecomm Global Services at 1-877-272-5250.

Electronic recording in Faulkner County works through the Business Information Systems platform. Once a document is submitted and accepted, it is recorded of record the same as a paper original. The electronic record gets an instrument number and is indexed by grantor and grantee the same way physical documents are. For high-volume users such as title companies closing multiple transactions per week, e-recording through one of these vendors is by far the most efficient option.

Under Arkansas Code § 14-2-301 et seq., the Uniform Real Property Electronic Recording Act governs how e-recorded documents are treated. An e-filed document accepted by the clerk during business hours is effective the same as a paper document filed in person. The content and formatting requirements are the same regardless of whether you submit in person or electronically.

Note: Even with e-recording available, all deed content requirements still apply. The document must have proper margins, be on 8.5 by 11 inch paper in electronic form, carry the preparer's name and address, and be properly executed before a notary or two witnesses.

Recording Fees in Faulkner County

Faulkner County follows the standard Arkansas fee schedule. The base recording fee is $15.00 for the first page and $5.00 for each additional page under Arkansas Code § 21-6-306. This rate covers deeds, deeds of trust, mortgages, release deeds, powers of attorney, notary bonds, foreign judgments, and materialman's liens. Plats and surveys are $15.00. Mortgage assignments and releases with multiple instruments cost $15.00 per instrument up to a maximum of $300.00.

A few fees are specific to court filings rather than deed recordings. Mortgagee's or Trustee's Notice of Default runs $140.00. Writs of garnishment or execution cost $20.00. Initiating a cause of action (civil filing) is $185.00. Appeals from District Court run $185.00 for civil cases and $170.00 for criminal appeals. The Real Property Transfer Tax of $3.30 per $1,000 of consideration applies to most Faulkner County property sales above $100.
